LAWS 2326 - Electronic Discovery

Students learn about the basics of electronic discovery, including how technology influences the practice law, how to communicate this information to their clients, and the most cost-effective discovery tools available. Students also learn about the historical development of the eDiscovery field; substantive legal precedent and case studies; procedural changes based on the Federal Rules of Civil Procedure; practical application of eDiscovery tools and resources; discussion of changing technology definitions, usage and trends; and ethical considerations for the legal professional when managing electronic discovery and data.

Course Objectives

1. Learn how to gather, search, store, analyze and produce meaningful information in a variety of file formats under significant business and legal constraints.

2. Draft or propound discovery requests seeking electronically stored information.

3. Explore new and evolving approaches to the management of discoverable electronically stored information.

4. Prepare an eDiscovery plan to obtain relevant information, while respecting confidentiality rights, individual privacy, and trade secret rights.

5. Demonstrate an understanding of compliance with state and federal eDiscovery law and changing case law.
