LAWS 2325 - Bankruptcy, Credit and Collections Law

Students learn about laws governing bankruptcy, voluntary and involuntary petitions, liens, preferences, powers of trustee, rights of debtors and creditors, liquidations, and discharge of bankruptcy. Students examine the legal avenues for the collection of debt, including garnishment and seizures.

Course Objectives
  1. Explain the legal framework governing debtor-creditor relationships, including the creation, classification, and enforcement of secured and unsecured debt under state and federal law.
  2. Identify the procedural and substantive provisions of the United States Bankruptcy Code and related rules, including Chapters 7, 11, and 13, and their application to consumer and business bankruptcy cases.
  3. Describe the roles and responsibilities of key participants in bankruptcy proceedings, including debtors, creditors, trustees, attorneys, and the U.S. Trustee.
  4. Examine bankruptcy procedures for various scenarios, including filing petitions, preparing schedules, administering the estate, and addressing creditor claims and exemptions.
  5. Compare and contrast the treatment of claims, dischargeability of debts, and plan confirmation requirements across different bankruptcy chapters.
  6. Apply strategic considerations in business reorganizations, including debtor-in-possession operations, post-petition financing, executory contract management, and employee retention plans.
  7. Draft essential bankruptcy documents, including petitions, schedules, statements of financial affairs, proofs of claim, reaffirmation agreements, motions for relief from stay, and plans of reorganization.
