LAWS 1509 - Ethics and Immigration Advocacy and Compliance

Students learn about immigration fraud, the unauthorized practice of law, and state legislation on immigration reform. Topics include an overview of notary, immigration specialist, and immigration consultant fraud; the Board of Immigration Appeals accredited agency and accredited representative programs; and contemporary issues in immigration reform. This course also surveys Form I-9 compliance, e-verify, Social Security No Match letters, and Department of Homeland Security Enforcement through ICE raids and audits. Course Objectives

Explain the development of the qualifications for citizenship and the grounds of inadmissibility of aliens in immigration law, as well as current public discourse and various proposals for immigration reform.
Describe the authority of Congress and of agencies, and rights and responsibilities of non-citizens pursuant to the US Constitution.
Articulate issues related to the unauthorized practice of law, immigration fraud, notarios, competency and ineffective assistance of counsel, and ethical responsibilities such as confidentiality and dual representation.
Explain circumstances surrounding the successful interaction of accredited representatives with attorneys, law enforcement and government officials.
Describe the process of verification of employment authorization of workers, recordkeeping, and audits.
Research topics relating to issues involving ethics, advocacy and compliance, as well requirements for certification of organizations and accreditation of individuals.
Draft documents relating to ethics, advocacy and compliance, as well as certification of organizations and accreditation of individuals.
