LAWS 1110 - Litigation

4.5 Credits

Students review, analyze, and apply the Rules of Civil Procedure used in federal and state court systems to case scenarios to determine jurisdiction, venue, pleadings, motions, discovery, pre-trial, trial, and post-trial procedures. Students learn to perform the basic work of a paralegal in litigation. Students conduct legal research, investigation, draft pleadings, motions, discovery, and other documents commonly used in litigation.

Prerequisites: (2) LAWS 1101 with a grade of C or better and LAWS 1230

Course Objectives

Explain the organization of the federal and state court systems.
Locate and describe the laws and court rules governing jurisdiction, venue, and court procedures.
List and describe the basic rules of litigation from commencement of a lawsuit to final disposition of the case.
Distinguish and explain differences between civil litigation and other litigation, and alternative dispute resolution.
Analyze case scenarios to determine the next steps in litigation planning and strategies.
Draft pleadings, motions, discovery devices, and documents commonly used in litigation.
Distinguish and discuss the roles of the attorney and paralegal in litigation.
Identify and apply professional ethics rules to issues that arise in a paralegal’s work in litigation.
